Pakistan Tehreek-e-Insaf has demanded the immediate announcement of the election date from the President Dr. Arif Alvi. The Central Secretary General of Pakistan Tehreek-e-Insaf Umar Ayub Khan has written a letter to the President Dr. Arif Alvi in ​​this regard. In the letter, Umar Ayub He said that Article 48 (5) of the Constitution obliges the President to fix a date within ninety days for holding elections in case of dissolution of the National Assembly by the President.





The Supreme Court of Pakistan in Sabatin Khan v. Election Commission of Pakistan v. Punjab and KP has interpreted this article of the Constitution with full appreciation in its judgments regarding the holding of elections in Punjab and KP.

In the light of the constitution and the decision of the Supreme Court, determining the date of elections is the prerogative and the most important constitutional duty of the president, Umar Ayub added that Article 5 of the constitution binds every citizen to be loyal to the state and to obey the constitution and the law. .

According to the preamble of the constitution, the state is obliged to exercise its powers and authority only through the elected representatives of the people. Therefore, the National Assembly elections are the basic requirement of democracy, without which the constitution for the state is not possible. You dissolved the National Assembly on August 9 on the advice of the Prime Minister. It is also your responsibility to determine the date of elections after the dissolution of the assembly.

Section 57 of the Elections Act, 2017 regarding the fixing of date of elections is generally subject to the Constitution. The absolute law of the constitution and the law is that the constitution has complete supremacy over all the laws in force in the country. Therefore, according to Article 48(5) of the Constitution, it is your responsibility to determine the date of the elections as the President of the State. Umar Ayub said that as the President of the State, you should fulfill the constitutional requirement of determining the date of the elections so that the people can be represented by their representatives. to be able to be elected and start working according to the constitution and the intention of the people.
