The Election Commission has suspended the notification on the request of Salman Akram Raja. It may be recalled that the Islamabad High Court had issued a notice to the Election Commission on the request to annul the notification of the victory of Aoun Chaudhry from National Assembly Constituency NA 128. On Wednesday, Chief Justice of Islamabad High Court Amir Farooq heard the request.
During the hearing, the Islamabad High Court has sought a reply from the Election Commission on the request of Salman Akram Raja by tomorrow Thursday.
Salman Akram Raja has requested NA 128 to annul the notification of Aun Chaudhry's success. PTI-backed independent candidate Salman Akram Raja had filed a petition in the Islamabad High Court. On the other hand, the Lahore High Court has reserved its decision after hearing the arguments on the petition against the success of Aun Chaudhry from Constituency NA 128 Lahore. That unknown assailants attacked the Model Town polling station and tortured fellow supporters, the Returning Officer was prevented from participating in the compilation of the results, the Returning Officer passed an order contrary to the Election Act, the Returning Officer did not release the results. Doing so is a violation of the Election Act.
There is a fear of the returning officer changing the results, the court is requested to order the returning officer to declare the results and the court to order the petitioner to participate in compiling the results to the RO.
During the hearing, Supreme Court Bar President Shehzad Shaukat, the lawyer of Aoun Chaudhry, told the court that the application is not admissible, Form 47 becomes meaningless in the presence of Form 48, the Election Commission has the authority to take decisions on such matters. Election tribunals will be formed to hear the petitions, other forums exist to hear and resolve disputed issues.
